This website is operated by Scheid Family Wines. Throughout the site, the terms “we”, “us”, “our” and “Company” refer to Scheid Family Wines. Scheid Family Wines offers this website (the “Site”), including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

Our store is hosted on Shopify, Inc and/or Wine Direct. They provide us with an online e-commerce platform that allows us to sell our products and services to you.

We reserve the right to refuse service to anyone for any reason at any time.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

USER AGE

By agreeing to these Terms of Service, you represent that you are the age of 21 or over. Because of the nature of the Company’s business, and its products and services, the Site is not intended for use by persons under age 21. The Company does not knowingly attempt to solicit or receive any information from persons under age 21. Use of the Site, or any registration that may be required to access portions of the Site, or to purchase products or services, including alcoholic beverages, may only be made by those persons who are at least 21 years of age. By using the Site, you are representing that you are at least 21 years of age, that the person placing the order and receiving a shipment of alcoholic beverages from us is over the age of twenty-one and that receipt of shipments containing alcoholic beverages requires the signature of a person 21 years of age or older who is not intoxicated.

You also agree that any alcohol purchased from the Site is intended for personal consumption and not for resale. If you do not agree with these conditions of use, please do not use this Site. If you intentionally or unintentionally misrepresent your or someone else’s age in order to provide alcohol to a person under the age of twenty-one, Company shall have the right to take action against you or seek indemnification from you for any suit to which we may be subject to the full extent allowable by law.

As required by the Communications Decency Act of 1996, the Company hereby notifies you that parental control protections (such as computer hardware, software, or filtering services) are commercially available that may assist you in limiting access to content that may be harmful to minors.

Please be aware that some jurisdictions do not permit certain uses of this Site by its citizens due to state and/or local laws restricting the sale and/or promotion of alcoholic beverages. You are responsible for compliance with the laws of your home territory or country. By using the Site, you are representing that you are permitted to do so under the laws and regulations of where you live.

Any trademarks reproduced on our websites that are not the property of or licensed to, the operator is acknowledged on the website.

Unauthorized use of this website may give rise to a claim for damages and/or be a criminal offense.

PRODUCTS OR SERVICES

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.

We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

CREDIT CARD CHARGES

Orders are by credit card only. We accept Visa, MasterCard, and American Express. By entering your credit card information for your order with us, you are committing to the payment to Company and bound by the terms of your credit card agreement.  The billing address for any such credit card needs to be provided at the time of your order and must be the address on your credit card statement. The billing address will be the address where your order will be shipped. If you wish to ship to an address different than your billing address, please provide this information at the time of your order. Please refer to the Privacy Policy HERE as to how we use your address information.

AUTOMATIC RENEWALS

Subscriptions and Wine Clubs

All of the above membership offerings are offered as subscription programs that automatically renew unless and until you cancel your membership or your membership is terminated pursuant to these terms and conditions of use.

By signing up as a member, you are agreeing to the automatic renewal of your membership and having your credit card automatically charged for the number of times per year agreed to, prior to each shipment the amount charged per shipment for each membership level depends on the membership selected, plus any applicable taxes and shipping charges. 

Cancellation of Membership:

In order to cancel your subscription or membership please send an email to contact@scheidvineyards.com

 

We must receive your notice of cancellation at least one week prior to the next shipment for it to be effective prior to that shipment.

We will send you a confirmation email with the automatic renewal disclosure and cancellation information to the email address you provide us.  Please make sure to keep a copy for your records. 

Sales and Shipping

All orders are processed at, and shipped from, Wine Direct, 450 Green Island Rd, American Canyon, CA 94503. During the winter and summer months, weather conditions and longer delivery times can often result in the spoilage of your order. Please note that when your wine order is picked up by the common carrier for delivery, the wine becomes your responsibility/We want to ensure that you receive the wine you order from us in good condition

You agree that you are not purchasing wine from Company to ship to another state or resell.

Please note that Company may not be able to ship wine to certain states. Due to changing direct-shipping laws and regulations, the list of states that we ship to may change at any time. The company will arrange for shipment on behalf of the buyer, to an address specified by the buyer, provided that Company in its sole discretion believes that such shipment will not subject us to the risk of any sort of legal action or other harm. The Site will not allow you to place an order if we cannot legally ship to you./If you live in a state where the direct shipment of wine by us may violate the law, we will contact you to discuss shipping options, which options may include the provision of an alternative shipping address in a state where the direct shipment of wines to consumers is permitted or storage of the wines at an acceptable third-party storage facility.

We will notify you by email when your wines are ready to be shipped. Please be aware that your order may be delayed until ideal weather and shipping conditions arise to protect your wines. An adult signature will be required for the delivery of alcoholic beverages. To ensure prompt and successful deliveries of your wines, please ensure that an adult 21 years of age or older will be present and available to sign for your shipment. If no one will be at home to accept delivery, we recommend using a business address for shipping or arranging with your shipper to hold your shipment at their location for pickup.  We will not be held responsible for any shipment delays (or wine damaged as a result of such delays) caused by erroneous information provided by the customer at the time of ordering or caused by the failure of an adult to be present for signature at the time the wines are delivered.

ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

OPTIONAL TOOLS

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.

You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations, or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms of Service.
